We are sending an official reply to the Colonial
[4] office letter of 8th August (33800/7/34) regarding the
and
[2] proposed Ordinance to regulate the entry and departure of
persons into and out of the colony of Hong Kong, indicating
that we have no observations to offer.
We think it desirable, however, to point out in
connection with sections 3(3) and 4(1) that a person may
not be a national of the country in which he was born and
probably would not be where the nationality law of the
country is based on the jus sanguinis and not the jus soli.
If he is not a national of it he should not be repatriated
to it without the consent of the government of the country.
In these circumstances it is suggested that it would be
desirable to omit "country of birth" from the Ordinance and
to limit the powers vested in the police officer to returning
the alien to the country of which he is a national or to a
port/
